CyberTraderHunterPI, LLC Terms of Service

 Introduction and Acceptance

These Terms of Service (“Terms”) govern your access to and use of the CyberTraderHunterPI, LLC website and online portal (“Site”), as well as the services provided therein (“Services”). By accessing or using the Site, you (“you”, “your”) agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Site.

CyberTraderHunterPI, LLC (“CyberTraderHunterPI”, “we”, “us”, “our”), a Virginia-based private investigation agency, reserves the right to modify these Terms at any time. Any modifications will be effective upon posting on the Site, and your continued use after such modifications signifies acceptance.

User Eligibility

By using the Site, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into this agreement. Access to the Site from outside the United States is at your own risk.

Services Provided

CyberTraderHunterPI, LLC is a licensed private investigation agency operating in Virginia, providing case management, client communication, billing, and digital evidence acquisition services. We utilize CaseFox, a cloud-based legal software solution, to manage these services, and Xero for financial transactions. All data is handled through CaseFox’s secure platform ([CaseFox Data Security](https://www.casefox.com/data-security/)).

User Responsibilities

You agree to maintain the confidentiality of your account credentials and not to misuse the Services. You shall not employ the Site for any unlawful or fraudulent purpose and agree to cooperate with any investigation into such activities. CyberTraderHunterPI, LLC may require additional verification of identity or other background information before granting or continuing Site access and reserves the right to reject any application.

Content and Intellectual Property

The Site and its content are owned by CyberTraderHunterPI, LLC or its corporate parent, DBA KING.PI.HUNTER. This includes all text, graphics, logos, images, and software, which are protected under U.S. and international copyright and trademark laws. You are granted a non-exclusive, non-transferable, limited license to access and display this content for personal use only. Any other use requires express written consent from CyberTraderHunterPI, LLC.

Third-Party Links

The Site may contain links to third-party websites. CyberTraderHunterPI, LLC is not responsible for the availability or content of these websites and does not endorse them. You use third-party websites at your own risk.

Survival: Provisions relating to claims, indemnification, warranties, and data use survive termination.
Notices: Written notices to CyberTraderHunterPI, LLC are to be sent to our registered agent’s address.
Modifications: CyberTraderHunterPI, LLC reserves the right to modify these Terms at any time.
Assignment: Rights under these Terms cannot be transferred without written consent.
Severability:  If any provision is deemed unenforceable, the remainder shall remain in effect.

These Terms constitute the entire agreement between you and CyberTraderHunterPI, LLC regarding the Site and Services. Please review them periodically to stay informed of any changes.

Additional Legal Provisions

Site Ownership and Intellectual Property
Ownership: The Site and Services are owned by CyberTraderHunterPI, LLC and its corporate parent, DBA KING.PI.HUNTER. All intellectual property rights, including copyrights, trademarks, and patents, are held by CyberTraderHunterPI, LLC or its licensors.
Limited License: Customers are granted a non-exclusive, non-transferable license to access and use the Site’s content for personal use, subject to these Terms. Any unauthorized use may result in termination of this license.
Trademarks and Service Marks:  Trademarks and service marks appearing on the Site are protected by law and may not be used without express permission from CyberTraderHunterPI, LLC.

Third-Party Content and Services
Independence from Third-Party Content: Content provided by third parties on our Site is not endorsed by CyberTraderHunterPI, LLC. We are not responsible for the accuracy of such content.

Section 230 Immunity:  As an interactive computer service provider, CyberTraderHunterPI, LLC is protected under Section 230 of the Communications Decency Act against liability for third-party content.

Customer Account Verification
Customer Verification: CyberTraderHunterPI, LLC may require additional verification of a customer’s identity or background before granting or maintaining access to the Site. We reserve the right to reject any application for access without recourse.

Data Handling and Privacy Compliance
Consent for Data Use: Customers must provide documented consent for any access to their data. We comply with regulations such as COPPA, FINRA, FFIEC, GLBA, and CFFAA in our data handling practices.
Data Protection Measures:  All data transactions are handled securely through CaseFox and Xero, with detailed privacy and data protection measures outlined on their respective sites.

Disclaimer and Limitation of Liability
No Warranty: Use of the Site is at your sole risk. CyberTraderHunterPI, LLC provides the Site and Services “as is” without warranties of any kind.
Liability Cap: Our liability is limited. CyberTraderHunterPI, LLC is not liable for indirect, consequential, or punitive damages.

Indemnification
You agree to indemnify CyberTraderHunterPI, LLC against any liability arising from your use of the Site, including losses or damages from unauthorized access to your account.

Governing Law and Arbitration
Governing Law:  These Terms are governed by the laws of the State of Virginia, without regard to conflict of law principles.  

Mediation and Arbitration:  Disputes will first go through mediation with the American Arbitration Association. If unresolved, they will be subject to binding arbitration.

Entire Agreement
These Terms constitute the complete agreement between you and CyberTraderHunterPI, LLC regarding your use of the Site. Any conflicting previous agreements are superseded.

Modifications and Notices
Right to Modify: CyberTraderHunterPI, LLC may modify these Terms at any time, with changes effective upon posting.
Notices: All notices related to these Terms must be sent in writing to CyberTraderHunterPI LLC’s registered agent.

Additional Terms and Conditions

 Survival of Terms
In the event of termination or cancellation of the Services, any provisions of these Terms related to claims, indemnification, warranties, and use of data will continue to remain in effect.

 Assignment
Except as explicitly allowed in these Terms, you may not assign or transfer any rights or obligations under these Terms without prior written consent from CyberTraderHunterPI, LLC.

  Severability
If any provision of these Terms is found to be unenforceable, that provision shall be enforced to the maximum extent possible, and the remainder of the Terms shall continue in full force and effect.

Waiver
Failure by CyberTraderHunterPI, LLC to enforce any provision of these Terms shall not be deemed a waiver of future enforcement of that or any other provision.

Relationship of Parties
You and CyberTraderHunterPI, LLC are independent contractors, and nothing in these Terms creates an agency, partnership, or joint venture relationship.

  Capacity to Contract
By entering into these Terms, you represent and warrant that you are of legal age and have the authority to enter into the agreement.

Federal and State Law Compliance
CyberTraderHunterPI, LLC complies with all applicable federal and state laws, including but not limited to COPPA (Children’s Online Privacy Protection Act), GDPR (General Data Protection Regulation), CCPA (California Consumer Privacy Act), and FINRA, FFIEC, GLBA, CFFAA regulations.

 Notices
Any notices or communications required under these Terms must be in writing, sent to CyberTraderHunterPI, LLC via the contact information provided on our website.

 Dispute Resolution
In the case of a legal dispute, both parties agree to resolve the issue through binding arbitration by the American Arbitration Association as described in these Terms.
